Partner Visa (820/801) - Onshore

This visa is available if you are in a de facto relationship or married to an Australian citizen, Australian permanent resident, or eligible New Zealand citizen and currently in Australia. It allows you to live, work, study, and travel without restrictions in Australia with your partner.

SUBCLASS 820/801

The Partner Visa Subclass 820/801 is designed for individuals already in Australia who wish to be with their Australian partner. This visa is specifically for spouses (married) or de facto partners (cohabiting for at least 12 months or not living apart on a permanent basis). It's important to note that there are two types of Partner visas distinguished by their subclasses:

● Subclass 820/801: For onshore applicants.
● Subclass 309/100: For offshore applicants. Refer to the Partner Visa Subclass 309/100 page if you are offshore.

● Subclass 820: Temporary visa.
● Subclass 801: Permanent visa (eligible after two years on the Subclass 820 visa).
● Allows you to live, work, study, and travel without restrictions.
● Access to Medicare in most instances.

Before applying for a Subclass 820/801 Partner visa, you must meet the following criteria:
● You must be in Australia at the time of application.
● You must be in a genuine relationship with your sponsoring Australian partner.
● Your partner must be an Australian citizen, Australian permanent resident, or eligible New Zealand citizen.
● You must be over the age of 18 (limited exemptions apply).
● You must meet health and character requirements.
● Same-sex partners are eligible to apply for this visa.
